Elite Driver Jobs is a specialized recruitment platform that connects professional drivers with employers and recruitment agencies. We provide:

Job posting and application services
Driver profile and verification services
Applicant tracking system (ATS)
CV search and matching services
Communication tools between drivers and employers

Important: Elite Driver Jobs is a platform service provider, not an employment agency. We facilitate connections between drivers and employers but do not:

Employ drivers directly
Guarantee job placements
Act as an intermediary in employment contracts
Provide employment law advice

2. User Accounts and Registration

2.1 Eligibility

To use our Platform, you must:

Be at least 18 years old
Have the legal capacity to enter into contracts
Provide accurate and complete information
Comply with all applicable laws and regulations

2.2 Account Types

We offer different account types:

Driver Accounts: For professional drivers seeking employment
Recruiter Accounts: For companies directly hiring drivers and for recruitment agencies and consultants

2.3 Account Security

You are responsible for:

Maintaining the confidentiality of your login credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use
Keeping your account information accurate and up-to-date

2.4 Account Verification

We may verify your identity, qualifications, or business registration at our discretion. Failure to provide requested verification may result in account suspension or termination.

3. Platform Services

3.1 For Drivers

Our services for drivers include:

Creating and maintaining driver profiles
Applying for jobs posted by employers
Receiving job alerts and notifications
Elite Status verification (optional)
Access to Driver Perks program and exclusive discounts
Access to ThinkTank surveys and rewards
Communication with potential employers

3.2 For Employers and Recruiters

Our services for employers and recruiters include:

Posting job advertisements
Accessing our Applicant Tracking System (ATS)
Searching driver profiles
Managing applications and communications
Purchasing job creation and profile view credits
Subscription services (EliteMax)
Analytics and reporting tools

3.3 Service Availability

We aim to provide continuous service but do not guarantee:

Uninterrupted access to the Platform
Error-free operation
Availability of specific features at all times
Compatibility with all devices or browsers

4. User Responsibilities

4.1 Driver Responsibilities

As a driver user, you agree to:

Provide accurate information about your qualifications, experience, and credentials
Keep your driving license and certifications current
Maintain professional conduct in all communications
Only apply for jobs you are qualified for and genuinely interested in
Comply with all applicable employment and transportation laws
Notify us of any changes to your professional status or qualifications

4.2 Employer and Recruiter Responsibilities

As an employer or recruiter, you agree to:

Provide accurate job descriptions and requirements
Comply with all employment laws and anti-discrimination regulations
Treat all applicants fairly and professionally
Only post legitimate job opportunities
Maintain appropriate safeguarding of applicant data
Pay all fees and charges in accordance with our pricing terms
Ensure job postings comply with advertising standards

4.3 Content Standards

All users must ensure that content posted on our Platform:

Is accurate, current, and truthful
Does not infringe on third-party rights
Complies with applicable laws and regulations
Does not contain offensive, discriminatory, or inappropriate material
Does not include personal contact information in inappropriate locations

5. Payment Terms

5.1 Service Tiers

We offer the following service tiers:

Forever Free: One permanent job posting with ATS features
Premium Credits: Pay-per-job posting system (£175 per credit)
EliteMax Subscriptions: Monthly subscription service (from £695/month)
Driver Search Credits: Access to driver database (pricing varies)

5.2 Payment Processing

All payments are processed through our secure payment provider (Stripe)
Payment is due immediately upon purchase unless otherwise specified
Prices are stated inclusive or exclusive of VAT as applicable
We reserve the right to change pricing with 30 days' notice to existing subscribers

5.3 Refunds and Cancellations

Premium Credits: Non-refundable once purchased
EliteMax Subscriptions: Cancel anytime, no refunds for partial months
CV Search Credits: Non-refundable once purchased
Exceptional Circumstances: Refunds may be considered for technical failures or billing errors

5.4 Billing and Invoicing

Subscriptions are billed monthly in advance
Failed payments may result in service suspension
You are responsible for all applicable taxes
Invoices are available in your account dashboard

6. Verification Services

6.1 Elite Status Verification

We offer optional verification services for drivers including:

Driving license verification
Right to work checks
Professional qualification verification
Identity confirmation

6.2 Verification Disclaimers

Important Limitations:

Verification is based on information provided at the time of submission
We cannot guarantee the ongoing validity of credentials
Verification does not constitute a recommendation or endorsement
Employers remain responsible for conducting their own due diligence
We are not liable for errors in third-party verification services

6.3 Verification Data Handling

Verification documents are securely processed and then permanently deleted
Only verification status is retained, not underlying documents
Third-party verification providers may retain data as per their terms
You consent to data sharing with official verification bodies (e.g., DVLA)

7. Driver Perks Program

7.1 Program Overview

Elite Driver Jobs offers a Driver Perks program providing access to:

Exclusive discounts and deals from partner suppliers
Special offers on products and services relevant to professional drivers
Promotional codes for fuel, insurance, training, and other services
Access to partner websites and third-party platforms

7.2 Eligibility and Access

Driver Perks may be available to all registered drivers or restricted to Elite Status drivers
Eligibility requirements are clearly stated for each offer
Access to specific perks may require verification of professional credentials
We reserve the right to modify eligibility criteria with reasonable notice

7.3 Partner Relationships and Offers

Third-Party Partnerships:

Driver Perks are provided through partnerships with external suppliers
Discount codes and offers are subject to partner terms and conditions
We act as an intermediary, not as the provider of goods/services
Partners may change or withdraw offers at any time

Offer Limitations:

Discounts and promotional codes have expiration dates and usage limits
Offers are non-transferable and for personal use only
Combining offers or using codes for commercial purposes is prohibited
Availability may be limited by geographic location or supplier restrictions

7.4 Driver Perks Disclaimers

Important Limitations:

We do not guarantee the availability, accuracy, or value of any offer
Partner suppliers are responsible for fulfilling their products and services
We are not liable for disputes arising from third-party transactions
Quality, delivery, and customer service are the responsibility of partner suppliers
Drivers must comply with partner terms and conditions when using perks

7.5 Program Changes

We reserve the right to:

Add, modify, or remove perks and partners at any time
Change eligibility requirements with reasonable notice
Suspend or terminate the program with 30 days' notice
Update program terms and conditions

7.6 Responsible Use

Drivers agree to:

Use perks and discount codes only for legitimate personal purposes
Not share, sell, or distribute codes to unauthorized parties
Comply with all partner terms and conditions
Report any misuse or fraudulent activity
Respect intellectual property rights of partners

8. Intellectual Property

7.1 Platform Ownership

Elite Driver Jobs retains all rights to:

Platform software, design, and functionality
Trademarks, logos, and branding
Proprietary algorithms and matching technology
Database structure and organization
Content we create or commission

8.2 User Content

You retain ownership of content you submit but grant us:

License to use, display, and distribute your content on the Platform
Right to modify content for technical compatibility
Permission to use aggregated, anonymized data for analytics and improvement

8.3 Prohibited Uses

You may not:

Copy, reproduce, or distribute our Platform or content
Reverse engineer or attempt to extract our source code
Use our data for competing services
Scrape or systematically extract data from our Platform
Remove or alter copyright or proprietary notices

9. Employment and Legal Disclaimers

9.1 Employment Relationship Disclaimer

We Are Not an Employment Agency:

We do not hire drivers or recruit on behalf of employers
We do not participate in employment negotiations or contracts
We are not responsible for employment terms, conditions, or disputes
Users must comply with all applicable employment laws independently

9.2 Legal Compliance

Users Are Responsible For:

Compliance with employment law and regulations
Anti-discrimination and equal opportunity requirements
Immigration and right-to-work verification
Health and safety obligations
Data protection compliance when handling personal information

9.3 Professional Licensing

Drivers remain responsible for:

Maintaining valid professional licenses
Complying with driving regulations and restrictions
Meeting medical and fitness requirements
Ongoing professional development and training requirements

10. Prohibited Activities

10.1 Platform Misuse

You must not:

Use the Platform for any illegal or unauthorized purpose
Interfere with or disrupt Platform operations
Attempt to gain unauthorized access to systems or data
Use automated tools to access the Platform without permission
Create multiple accounts to circumvent restrictions

10.2 Content Violations

Prohibited content includes:

False, misleading, or fraudulent information
Discriminatory or harassing material
Offensive, inappropriate, or unprofessional content
Spam, unsolicited marketing, or irrelevant postings
Content that violates intellectual property rights

10.3 Commercial Restrictions

You may not:

Resell or redistribute Platform access
Use the Platform to compete with our services
Extract data for commercial use outside the Platform
Post jobs for positions that don't exist
Collect user information for unauthorized purposes

11. Termination

11.1 Termination by You

You may terminate your account at any time by:

Using the account deletion feature in your settings
Contacting customer support
Ceasing to use the Platform (account may be deactivated for inactivity)

11.2 Termination by Us

We may suspend or terminate your account for:

Violation of these Terms
Illegal or fraudulent activity
Repeated complaints or policy violations
Non-payment of fees
Inactive accounts (after 24 months)

11.3 Effect of Termination

Upon termination:

Your access to the Platform will cease
Posted jobs and applications will be removed
Account data will be handled according to our Privacy Policy
Payment obligations remain for services already provided
These Terms continue to apply to past use of the Platform

12. Limitation of Liability

12.1 Service Limitations

We Provide the Platform "As Is" and Do Not Guarantee:

Specific hiring outcomes or job placements
Accuracy of user-provided information
Compatibility between drivers and employers
Continuous, error-free service availability
Protection against all security threats

12.2 Limitation of Damages

Our Liability Is Limited To:

Direct damages only (no indirect, consequential, or punitive damages)
Maximum of fees paid to us in the 12 months preceding the claim
Refund of specific charges where service was not provided as promised

12.3 Excluded Liabilities

We Are Not Liable For:

Employment disputes between users
Verification errors or omissions
Actions or omissions of third-party service providers
Driver Perks program offers, availability, or partner supplier issues
Data breaches beyond our reasonable control
Business losses or lost profits
Decisions made based on Platform information

12.4 Indemnification

You agree to indemnify us against claims arising from:

Your use of the Platform
Your violation of these Terms
Your violation of applicable laws
Content you submit to the Platform
Employment-related disputes involving you

13. Dispute Resolution

13.1 Informal Resolution

Before pursuing formal action, parties agree to:

Attempt to resolve disputes through direct communication
Use our customer support process for Platform-related issues
Provide 30 days' written notice of any intended legal action

13.2 Governing Law

These Terms are governed by the laws of England and Wales, and disputes will be subject to the exclusive jurisdiction of the English courts.

13.3 Alternative Dispute Resolution

For eligible disputes, we may agree to:

Mediation through an approved service
Arbitration under established rules
Industry-specific resolution procedures

14. General Terms

14.1 Changes to Terms

Providing 30 days' notice of material changes
Requiring acceptance for continued use of paid services
Notifying users via email for significant modifications

14.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Elite Driver Jobs regarding the Platform.

14.4 Assignment

We may assign these Terms or any rights hereunder. You may not assign your rights or obligations without our written consent.

14.5 Waiver

Our failure to enforce any provision does not constitute a waiver of that or any other provision.

14.6 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.

14.7 Notices

Official notices will be sent to:

The email address associated with your account
Your registered business address (for employers)
Posted prominently on the Platform

14.8 Survival

Provisions regarding intellectual property, limitation of liability, indemnification, and dispute resolution survive termination of these Terms.
